The Supreme Court on Tuesday closed the criminal prosecution against 30 army personnel in the case of the death of 13 people during an operation in Mon district of Nagaland in 2021. The central government had refused to give permission for legal action in this case. Under the AFSPA law, further action cannot be taken against these personnel without the approval of the government. A bench of Justice Vikram Nath and Justice PB Varale said that the Center had refused to allow action against these personnel on February 28. However, the bench said that if at any time in the future, approval is given to prosecute under Section 6 of AFSPA, then action can continue on the basis of the respective FIR.
